Article 1 — Seller’s Identity

The website adartparis.com (hereinafter “the Site”) is published by ADART, in Paris (France). Hereinafter “the Seller.”

Article 2 — Purpose and Scope

These General Terms and Conditions of Sale (GTC) govern all sales of photographic prints concluded on the Website between the Seller and any non-professional individual (hereinafter “the Customer”).
Any order implies prior, full, and unconditional acceptance of these Terms and Conditions. The Seller reserves the right to modify them at any time; the applicable Terms and Conditions are those in effect on the date of the order.

Article 3 — Products

The products offered are photographic prints, made to order according to the format, medium, and finish selected by the Customer. Their key characteristics (dimensions, type of paper or medium, finish) are described on each product page.
The illustrative images are not contractually binding. Slight variations in color or appearance may occur between the on-screen display and the final print due to differences in monitors and printing processes.

Article 4 — Prices

Prices are listed in euros, excluding tax (HT). VAT is not applicable, pursuant to Article 293 B of the French General Tax Code (CGI). Shipping costs are specified before the order is confirmed and are added to the price of the products.
The Seller reserves the right to change its prices at any time. Products are billed based on the price list in effect at the time the order is confirmed.

Article 5 — Order

The Customer selects their products, adds them to the shopping cart, reviews the order summary, and then confirms their order after checking the box labeled “I have read and accept the terms and conditions of sale.”
The sale becomes final upon confirmation of the order by email and receipt of payment. The Seller retains an electronic copy of each order as proof.

Article 6 — Payment

Payment is made online at the time of ordering using the methods offered on the Site. Transactions are secured by payment service providers (Stripe, PayPal, etc.).
The order is processed only after payment has been confirmed.

Article 7 — Delivery

Products are delivered to the address provided by the Customer when placing the order.
Delivery times are provided for informational purposes only on the product page or at the time of order (generally 3 to 5 business days after shipment, including made-to-order production). The risks associated with shipping are transferred to the Customer upon receipt.
In the event of a damaged package, a missing product, or a non-compliant product, the Customer is asked to report the issue as soon as possible via email, including supporting photographs.

Article 8 — Right of Withdrawal

8.1 — Custom-made or personalized prints

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer’s specifications or that are clearly personalized.

Prints made to order according to the Customer’s specifications (format, medium, finish) are therefore not eligible for cancellation, return, or refund, except in the event of a defect or non-conformity (see Article 9). The Customer is informed of this before confirming the order.

8.2 — Standard Edition Prints

For standard-edition prints—sold from stock and not personalized—the Customer has fourteen (14) days to exercise their right of withdrawal without having to provide a reason or incur any penalties.

This period begins on the day the Customer, or a third party designated by the Customer, takes physical possession of the product. If the order consists of multiple products delivered separately, the period begins on the day the last product is received.

How to exercise this right. Before the deadline expires, the Customer must notify the Company of their decision by means of an unambiguous statement sent via email.

Product Return. The Customer must return the product, in its original condition and packaging, within fourteen (14) days of receiving notice. The Customer is responsible for the direct costs of the return. The Customer is liable only for any depreciation of the product resulting from handling other than that necessary to determine the nature and characteristics of the product.

Refund. The Seller will refund the full amount paid, including standard shipping costs, no later than fourteen (14) days after being notified of the decision to cancel the order. The Seller may delay the refund until the product has been returned or until the Customer has provided proof of shipment. The refund will be issued via the same payment method used when placing the order, unless the Customer expressly agrees to a different method.

Article 9 — Statutory Warranties

In addition to any commercial warranty, the Customer is entitled to:

  • the statutory warranty of conformity (Articles L217-3 et seq. of the Consumer Code);
  • the warranty against hidden defects (Articles 1641 et seq. of the Civil Code).

If a product is nonconforming or has a hidden defect, the Customer may, depending on the circumstances, request repair, replacement, or a refund. Any such request must be submitted by email.

Article 10 — Personal Data

The data collected when you place an order is necessary for order processing, billing, and delivery. It is retained for as long as necessary to manage the business relationship and comply with legal obligations (particularly accounting requirements).
In accordance with the General Data Protection Regulation (GDPR), the Customer has the right to access, rectify, erase, restrict, and object to the processing of their personal data, which they may exercise by email. For more details, see the Privacy Policy du Site.

Article 11 — Complaints and Consumer Mediation

Any complaints may be submitted by email. The Seller will endeavor to respond as soon as possible.
In accordance with Articles L612-1 et seq. of the Consumer Code, if a prior written complaint has been unsuccessful, the Customer may seek the assistance of a consumer mediator free of charge.

Article 12 — Governing Law and Disputes

These Terms and Conditions are governed by French law.
The fact that the Seller does not invoke any of these provisions at a given time shall not be construed as a waiver of the right to invoke them at a later time.
If an amicable resolution cannot be reached, any dispute shall be subject to the jurisdiction of the French courts, under the terms set forth in the Consumer Code.
